At Laxå Pellets AB, we value your privacy and are committed to protecting the personal data you share with us. This Privacy Policy explains how we collect, process, store, and safeguard your personal data when you interact with us as a customer, website visitor, or through other forms of contact.

Laxå Pellets AB, Company Registration Number 556647-9969, is hereinafter referred to as “LP” and acts as the data controller. You, or the company you represent, are referred to as “the customer”.

LP is responsible for all personal data that you provide to us when you interact with us via our website, telephone, email, social media channels, or in person, for example at trade fairs or other events.

Scope of This Privacy Policy

This Privacy Policy applies to all individuals who visit our website laxapellets.com, make purchases, or otherwise communicate with LP via telephone, email, social media, or in person, such as at trade fairs or at our industrial premises.

Personal data refers to any information that can be used, either alone or in combination with other information, to identify a living natural person. This may include, for example, your name, email address, or telephone number.

As the data controller, LP is responsible for ensuring that your personal data is processed securely and in accordance with the EU General Data Protection Regulation (GDPR). GDPR replaces the former Swedish Personal Data Act (PUL).

Personal Data We Collect and How We Use It

The primary purpose of processing your personal data is to enable LP to fulfill its contractual and legal obligations towards you as a customer. We may also process personal data relating to individuals or companies that are not yet customers but have requested to be contacted by us.

Ordering of Pellets, Customer Support, Delivery and Invoicing

When you purchase pellets from us, we collect and process your contact details, including your name, address, telephone number, and email address. This information is necessary for us to process your order, communicate with you, deliver the pellets, and invoice you. We may also store delivery instructions, directions, and any specific requests related to the delivery.

The purchase agreement entered into between you and LP constitutes the legal basis for this processing and is necessary for us to fulfill our contractual obligations towards you. We retain this information for five (5) years. This retention period is based on the fact that many of our customers place orders at long intervals and have expressed a wish to remain in our customer register in order to receive current offers. The data is also retained to handle potential complaints or claims.

To deliver the pellets, we engage external transport companies that are given access to your contact details and delivery instructions. For invoicing purposes, your data may in some cases be shared with InExchange AB, which distributes invoices on our behalf. If an invoice remains unpaid and reminders or debt collection measures are required, we may engage a debt collection agency, currently Preventia Finans (previously Axactor Sweden AB and Lowell Sverige AB).

User Account and Login Information

To place orders via our website, you are required to create a customer account using a unique username (your email address) and a password, in addition to the contact details described above. This information is used to verify your identity as a customer.

The legal basis for processing this data is the performance of our contract with you.

Login credentials are stored for five (5) years to ensure that you do not need to create a new account even if a long period passes between orders.

Personal Identity Number and Credit Checks

Your Swedish personal identity number (personnummer) is required in order to perform a credit check if you wish to pay by invoice. The credit check is carried out at the time of ordering and is necessary for granting credit.

The credit check is performed by Creditsafe i Sverige AB. A copy of the credit information retrieved is sent directly to you by Creditsafe. Credit checks conducted by Creditsafe do not affect your future credit rating, such as your ability to obtain bank loans.

LP stores information indicating that a credit check has been carried out, whether you were approved or declined, and the reason for any rejection. However, we do not store the detailed credit report itself. A new credit check will be performed for future orders if there have been changes since the previous check, such as changes in income.

If you choose not to provide your personal identity number, or if your credit application is declined, but you still wish to purchase from us, you may contact our customer service team to agree on an alternative payment method, such as advance payment instead of invoicing.

The legal basis for processing personal identity numbers is the performance of our contract with you.

Your personal identity number is stored together with your contact details and login information for five (5) years, as described in the sections above.

Bank Account Details

In cases where a refund is required, for example in the event of a complaint or an incorrect payment, we need to collect your bank account number in order to process the repayment. At present, we are only able to make refunds via bank transfer.

Your bank account number is registered solely for the purpose of making the payment and is not stored together with your other customer data.

The legal basis for this processing is the performance of our contract with you.

Information relating to completed payments is retained for seven (7) years after the end of the current financial year, in accordance with the Swedish Accounting Act.

Direct Marketing, Customer Activities and Customer Surveys

Your contact details may be used for direct marketing purposes in order to provide you, as a customer, with relevant offers via email, postal mail, or telephone. They may also be used to follow up on customer activities, for example to send prizes to participants in competitions held at trade fairs or similar events.

Customer surveys are conducted to understand how you experience LP and our pellet products. These surveys are carried out either by our own customer service team or by companies specializing in customer research. The responses are used to improve our services, tailor offers to you, and compile statistical data.

The legal basis for these processing activities is a balancing of interests, based on our legitimate interest and your interest in receiving marketing communications, providing feedback, and enabling us to improve our products and services.

Personal data used for these purposes is stored for five (5) years, as many of our customers place orders at long intervals and have expressed a wish to remain in our customer register in order to receive current offers.

When contact details are obtained through the purchase of address lists for direct marketing to potential customers, such data is stored for one (1) year. The legal basis for this processing is our legitimate interest in marketing our products and services.

Job Applicants

When you submit personal data to us as a job applicant, we process your information in order to evaluate your application and select the appropriate candidate. All application data is stored throughout the recruitment process and for an additional two (2) years thereafter, in case the position is not filled during the initial recruitment process and we wish to contact you regarding future employment opportunities.

The legal basis for this processing is a balancing of interests, based on our and your mutual interest in filling the position with a suitable candidate.

Suppliers

When you act as a supplier and submit an invoice to us for goods or services that we have purchased, we process your personal data in accordance with the information provided on the invoice. This data is used for payment processing, handling support matters, placing new orders, and maintaining the business relationship.

The legal basis for this processing is the performance of a contract and a balancing of interests, based on your and our mutual interest in continuing the business relationship.

Supplier data is retained for up to fifty (50) years due to requirements from our insurance provider to be able to verify purchase costs in the event of an insurance claim.

Contact via Telephone, Email, Social Media and Other Channels

When you contact us by telephone, email, social media, or other communication channels, we process and store your contact details in order to manage your enquiry, provide support, follow up on your request, or fulfill an agreement.

Depending on the nature of the matter, the legal basis for processing is either the performance of a contract or a balancing of interests, based on our and your legitimate interest in handling your enquiry.

The data is stored for up to five (5) years.

Camera Surveillance of LP’s Industrial Area

Camera surveillance is in place at the entrance gate to the industrial area, across LP’s premises, and within production and warehouse facilities. The purpose of the surveillance is to ensure safety and to monitor unauthorized access to the area. This enables us to detect, investigate, and prevent incidents such as accidents, injuries, damage, fire hazards, and similar events.

Camera surveillance is carried out 24 hours a day and includes real-time monitoring and recording of video footage. No audio recording takes place.

Real-time footage is accessible to personnel in the control room and to operational management. Recorded video files are protected by authorization and password controls and are accessible to the Production Manager, the Managing Director, and the safety representative. Selected cameras connected to logistics and weighing systems are accessible to sales and measurement staff in order to monitor inventory levels and assist drivers. IT technicians may also access recordings in connection with IT support.

Video recordings may be disclosed to law enforcement authorities, emergency services, or similar authorities when necessary. Recordings are normally stored for one (1) week. In the event of an accident, fire, suspected theft, or similar incident, recordings may be retained for the duration of the investigation.

The legal basis for camera surveillance is a balancing of interests. This includes the protection of individuals’ fundamental safety interests and LP’s legitimate interest in preventing and investigating damage or incidents.

Processing Required by Law

In addition to the processing described above, we may process your personal data where required by law, for example to comply with accounting obligations or in response to requests from public authorities.

The statutory retention period under the Swedish Accounting Act is seven (7) years. Even where certain personal data must be retained due to legal requirements, you always have the right to object to the use of your personal data for direct marketing purposes by contacting our customer service. Please also refer to the section Your Rights as a Data Subject at LP.

Use of Cookies

LP uses so-called cookies when you visit and use our website. A cookie is a small text file that is stored on your computer or the device you use when visiting our website. Cookies cannot personally identify you.

LP protects your personal data through a combination of technical and organizational measures. Access control systems are required for access to all LP systems that process personal data. Employees of LP, as well as data processors and sub-processors, are required to comply with LP’s internal information security policies.

Backups of stored data are primarily maintained locally to ensure data availability in the event of intentional or accidental loss. Accounting records are also stored in cloud-based services, where backups are performed several times per day.

The legal basis for this processing is compliance with legal obligations, such as the obligation to protect accounting records, as well as our and your legitimate interest in safeguarding personal data.

Personal data is retained in accordance with the retention periods specified under the section Personal Data We Collect and How It Is Used.

LP as a Data Processor

LP acts as a data processor for those of our resellers who place orders with direct delivery to you as the end customer. In such cases, a data processing agreement is entered into with the reseller.

LP processes personal data in accordance with the instructions attached to the data processing agreement. File transfers may occur as part of fulfilling these obligations.

Sub-Processors Used by LP

LP uses sub-processors to fulfill its contractual obligations towards you as a customer, for example transport companies and invoicing service providers. LP ensures that data processing agreements are in place with all sub-processors and that they, in addition to complying with GDPR, also adhere to LP’s requirements regarding data protection and confidentiality.

Transfer of Information

LP and its sub-processors store and process personal data within the European Union (EU). Accounting data is stored in Sweden.

We do not sell or otherwise transfer customer data to third parties for commercial purposes.

Your Rights as a Data Subject at LP

As a data subject, you have the following rights under the GDPR:

To exercise any of your rights, you must submit a written and personally signed request. The request must include your name, address, telephone number, email address, and personal identity number, and be accompanied by a copy of valid identification.

A response will be provided within one (1) month of receiving your request. An exception applies to objections or restrictions relating to direct marketing, in which case it is sufficient to contact our customer service by telephone or email.
